Public Records Request

Public Records Policy

The Fire Chief and the administrative staff are responsible for managing and maintaining East County Fire and Rescue’s official records.  The Public Records Officer will be determined by ECFR Board of Commissioners.

East County Fire and Rescue administrative staff manages the District’s legal documents such as deeds and contracts, by providing a records management system for storing and retrieving documents;  publishing and disseminating information for District business;  and recording and maintaining minutes of the Board of Commissioner meetings and workshops.

All requests for public records shall be made in writing and delivered in person or by mail, email, or fax using the District’s Request for Public Records form.  Requests delivered orally will not be accepted as a valid public records request.

East County Fire and Rescue shall respond to the request for public records within five (5) business days of receipt of the request.  In the event that a request for public records is received after 4:45 p.m. the request shall be deemed to have been received on the next business day.

The fee for printed public records is $ 0.15 per page and is payable upon receipt of the records requested.  Depending on size restrictions, electronic records may be delivered by CD, DVD, email, or by posting on the District’s website.    Records delivered on CD or DVD will be subject to a fee covering the cost of the CD or DVD.  There is no fee for records that can be delivered by email or by posting on the website.

If a requester chooses to inspect records, instead of receiving a copy, East County Fire and Rescue shall notify the requester when the requested records are available for inspection.  The records will be available for inspection during business hours, Monday through Friday, 8:00 a.m. to 4:00 p.m., excluding holidays, at a date and time mutually agreed upon by the requester and the District.  The time allowed to inspect records may be broken into more than one appointment.  Any appointment to inspect records shall not exceed two (2) hours unless mutually agreed upon by the requester and the District.  Records that have been pulled for inspection shall be made available to the requester for a period of no more than fourteen (14) calendar days.  If the requester fails to contact the District to arrange a time to inspect the records within fourteen (14) calendar days of being notified that the records are available for inspection: 1) the records will be returned to the file, and 2) the requester will need to submit a new Request for Public Records.

Denials of Public Records Requests will be issued in written form.  The denial shall include a statement of the specific exemption authorizing the withholding of the record and a brief explanation of how the exemption applies to the record withheld.
